GENERAL TERMS OF USE
These General Terms of Use ("Terms") shall apply in addition to the provisions of the relevant User Agreement / Service Agreement in all hosting/package and similar hosting services offered by PROJX. In the event of conflict, the special agreement/proposal provisions shall prevail.
1) E-MAIL USE AND LIMITS
1.1. In all our packages, unless otherwise stated, the e-mail quota per account is 250 MB.
1.2. Unless otherwise stated, the e-mail sending limit is 100 messages/hour. PROJX may change the limits in order to maintain service quality and anti-spam measures.
1.3. Use for bulk delivery/spam purposes is prohibited. In case of suspicious volumes, PROJX may temporarily restrict or stop the relevant deliveries.
2) BACKUP AND STORAGE
2.1. Backups taken by the Customer may, within technical possibilities, be kept on the server for 15 days, and may be automatically removed by the system after that period.
2.2. Backup responsibility lies with the Customer. PROJX cannot be held liable for any data loss unless caused by PROJX's fault.
2.3. Even if the Customer purchases an additional backup service, the Customer must take regular independent backups.
3) USE IN ACCORDANCE WITH THE INTENDED PURPOSE
3.1. Packages may not be used for purposes contrary to the concept of web hosting, such as file sharing, data storage, download center, archive/mirror, or as a backup space only.
3.2. Packages may not be used to provide services to third parties, for resale, or to abuse the infrastructure through multiple accounts/multiple sites (unless the proposal/plan explicitly permits this).
4) FREE MIGRATION SERVICE
4.1. For free site migration services, a 100% migration guarantee may not be provided due to technical/compatibility reasons. PROJX will make its best effort.
5) "UNLIMITED" FEATURES AND FAIR USE
5.1. Resources specified as "Unlimited" are subject to fair use principles. The aim is to enable our customers to receive service without hitting limits during ordinary usage.
5.2. Fair use control points (default):
- Monthly traffic: 50 GB
- Disk usage: 10 GB
5.3. If these thresholds are exceeded, PROJX may, in order to protect the health of the system, ask the Customer to reduce resource consumption, recommend a plan upgrade, or partially restrict the service.
6) CPU / RESOURCE USAGE LIMITS
6.1. Unless otherwise stated, the CPU usage limit is at the level of 25% of a single core. In some packages this ratio may go up to 50%.
6.2. PROJX may monitor resource usage (CPU, RAM, traffic, disk, I/O, MySQL/MSSQL, etc.). If the limits are exceeded, the system may automatically apply throttling, temporary suspension, isolation or redirection.
7) FILE COUNT (INODE) LIMIT
7.1. Unless otherwise stated, the inode limit in hosting packages is 100,000.
8) DOMAIN / ALIAS / PARK / ADDON RULES
8.1. Parked (park/alias) domains may only be used for the parallel publication of the existing website. In uses other than web publishing (mail, etc.), the relevant services may be restricted.
8.2. Addon/Alias/Park domain names may be used if they are registered as a domain name service in the user's account (or if explicitly permitted in the proposal/agreement).
8.3. In the case of use of domain names that do not belong to the Customer or that are registered with a different company, the responsibility to prove the right of use lies with the Customer. Where deemed necessary, PROJX may terminate the publication of the relevant domain name or remove it from hosting.
9) SHARED HOSTING SECURITY RESTRICTIONS
9.1. In shared hosting infrastructures, functions/libraries that may affect server security may not be allowed.
9.2. Additional functions may not be provided beyond the PHP functions offered in the control panel. Third-party module installations are the Customer's responsibility.
9.3. SSH access is not provided in shared hosting services (unless otherwise stated).
9.4. The following PHP functions are not allowed in the shared hosting infrastructure:
- exec
- escapeshellarg
- popen
- proc_open
10) INFRASTRUCTURE CHANGES
10.1. PROJX may make IP/server/infrastructure changes for security, performance, capacity planning, or operational requirements, in order to maintain service quality. Where possible, the Customer will be informed in advance.
11) CAMPAIGN / PROMOTION RULES
11.1. Benefits such as campaigns, discounts, promotions, free additional periods and similar are, unless otherwise stated, specific to the account/person/company.
11.2. Opening multiple accounts with different names/phones/e-mails to circumvent the rules will be considered an abuse of the benefit. In such cases, PROJX may suspend the relevant account/service and/or request the difference of the benefit amount.
12) ACCOUNT MANAGEMENT
12.1. Each account has a single administrator account.
12.2. If the same person/organization opens multiple accounts in a way that harms the security and operation of the system, PROJX may apply the necessary administrative measures.
13) TERMINATION OF SERVICE
13.1. PROJX may suspend/terminate the service for reasons of legislation, system security, misuse, payment breach, or to protect service continuity.
13.2. Refund/termination conditions are subject to the relevant Cancellation & Refund Policy and/or to the provisions of the service agreement.
14) RIGHT TO MAKE CHANGES
14.1. PROJX reserves the right to make changes to hosting packages, limits, and Terms. Changes are effective from the date of publication.
15) PRICE CHANGES
15.1. PROJX may change its prices upon 30 days' prior notice, due to reasons including, but not limited to, inflation, supply costs and/or legislative changes.
15.2. The Customer has the right to evaluate the change during the notice period. If the Customer does not accept it, and the change is adverse to the Customer, a right of termination may arise within the framework of the agreement/plan provisions.
16) DOMAINS NOT PERMITTED FOR REGISTRATION / TRANSFER
Domains found not to comply with the following rules are not permitted to be registered/transferred or hosted on our servers; where necessary, service may be suspended:
- Domains intended for use contrary to Law No. 5651 and related legislation
- Domains evoking/misleadingly referring to commercial bank names (e.g., "...branch" constructions)
- Names suitable for fraud, such as credit card/bill payment point names
- Names that misleadingly reference certain online gaming brands
17) CONTENT NOT PERMITTED FOR USE
The hosting of the following content is not permitted; if detected, the service may be restricted/suspended:
- Unlawful content within the scope of Law No. 5651
- Proxy/anonymizer, phishing content
- Bruteforce, exploit, attack tools; spam/mail-bombing scripts
- Warez/pirated content and platforms that redirect to such content
- Unauthorized live broadcasts (particularly sports broadcasts, etc.)
- Ponzi/pyramid schemes and deceptive investment setups
- Child abuse content: strictly prohibited; upon detection, immediate removal/suspension is applied.
18) ACCEPTABLE USE POLICY (AUP) – CODE OF CONDUCT
18.1. The following are considered unacceptable/unauthorized use and constitute a material breach. PROJX may, with written notice (and immediately when necessary), suspend or terminate the services:
- Hosting or spreading malicious software/viruses
- Content that infringes third-party rights or that involves harassment/hate speech/threats
- Activities that constitute or facilitate crime/fraudulent behavior
- Torrent/mirror/unauthorized distribution repositories or redirections
- Processing personal data without consent or breaching privacy
- Spam/junk mail or unauthorized advertising/promotional distribution
- Running processes/programs that block other users or damage the infrastructure
19) POLICY NOTES
19.1. Disk, traffic, CPU and similar resource consumption is not allowed to reach a level that adversely affects the overall health of the system.
19.2. A zero-tolerance approach is applied to spam.
19.3. The value of data varies according to the customer. Therefore, backup responsibility lies 100% with the Customer. If PROJX system backups are available, PROJX may try to assist within technical possibilities; however, this does not constitute a commitment.
20) RESTRICTIONS REGARDING SANCTIONED COUNTRIES
20.1. The services may be subject to restrictions targeting countries/persons/entities sanctioned by the Republic of Türkiye, the EU and/or member countries of the European Free Trade Association.
20.2. The Customer acknowledges that the services may not be resold/exported/transferred to sanctioned countries, and that they will comply with applicable legislation.
20.3. In the event of a breach, PROJX may immediately terminate the Terms and discontinue the service.
